Stay Safe in the Rain

     This is a reminder to all SoCal Drivers to stay safe in the rain! Statistics show that rain is one of the biggest contributing factors to car accidents.

How you react can prevent further injuries, reduce costs and accelerate the clean-up and repair process. Over 6.3 million police-reported motor vehicle crashes occurred in the United States in 1998. Almost one-third of these accidents resulted in injury. In 2001, nearly 42,000 people died on America’s roadways. Clearly, accidents are a part of life in America. So, if you are involved in a traffic collision, try to remain calm, and follow these steps:

Action Plan to Deal with Accidents:

1. Keep an Emergency Kit in Your Glove Compartment. Drivers should carry a cell phone, as well as pen and paper for taking notes, a disposable camera to take photos of the vehicles at the scene, and a card with information about medical allergies or conditions that may require special attention if there are serious injuries. Also, keep a list of contact numbers for law enforcement agencies handy. Drivers can keep this free fill-in-the-blanks accident information form handy. A set of cones, warning triangles or emergency flares should be kept in the trunk.

2. Keep Safety First. Drivers involved in minor accidents with no serious injuries should move cars to the side of the road and out of the way of oncoming traffic. Leaving cars parked in the middle of the road or busy intersection can result in additional accidents and injuries. If a car cannot be moved, drivers and passengers should remain in the cars with seatbelts fastened for everyone’s safety until help arrives. Make sure to turn on hazard lights and set out cones, flares or warning triangles if possible.

3. Exchange Information. Visit www.exchangeinfo.info to download our app from the Apple App Store or Google Play Store from any web enabled cell phone. Or visit www.gatherinfo.info from any web browser.

4. Photograph and Document the Accident. Use your camera to document the damage to all the vehicles. Keep in mind that you want your photos to show the overall context of the accident so that you can make your case to a claims adjuster. If there were witnesses, try to get their contact information; they may be able to help you if the other drivers dispute your version of what happened.

5. File An Accident Report. Although law enforcement officers in many locations may not respond to accidents unless there are injuries, drivers should file a state vehicle accident report, which is available at police stations and often on the Department of Motor Vehicles Web site as a downloadable file. A police report often helps insurance companies speed up the claims process.

Auto accidents take a tremendous toll on everyone involved, both financially and emotionally. If you’re one of the lucky ones who have thus far avoided a serious accident, hopefully the tips on prevention will help keep it that way. The chances are high, though, that at some point you will be involved in an accident. Just keep your head focused and make safety your primary concern. You’ll have plenty of time to deal with the consequences later.

Who is at fault?

You’re driving down Beverly Blvd, La Brea, Pico, Robertson, whatever street it may be and CRASH. You are in an accident. Maybe you were rear ended, maybe it was a side swipe, a turning accident, or a head on collision. It’s not your fault. But are you sure? Maybe you are sure but the other driver has a different opinion? Now its time to whip out the trusty old dash cam footage.

The below video was taken from a dash camera from a vehicle in Texas. The original Reddit post can be found here.

The victim was driving within her lane, sees a wide-turning vehicle, and ultimately stops in an effort to avoid hitting / being hit. She did everything she could but the other car, traveling in the opposite direction, hits her head on. What’s worse is that the other driver comes out and blames the victim! That’s what we call chutzpah!

In another example, at the intersection of Olympic and Fairfax in Los Angeles:

The car with the dash cam is going straight, two cars in the opposite direction make a left turn in front of the dash-cam equipped vehicle. The third car decides to turn also and clearly would have been at fault if the accident had actually occurred.

To some people it is obvious that the turning vehicle has to wait for traffic to clear before initiating a turn (which is the law), but other people might say “we both had the green”.

California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left… shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Luckily the accident was avoided due to the at-fault party correcting her mistake.  The vigilant driver (of the dash-cam car) also slowed down fast enough and avoided a collision.

Clearly, in both of the above scenarios the dash-cam equipped vehicle driver is not at fault.

We highly recommend purchasing a dash cam video camera. They are fairly inexpensive and are worth every dollar when needed. The footage may very likely be admissible in court if you have the proper representation.

Without this camera footage, it would be “he said / she said”.

Quick Reaction Driver Saves Self From Accident

The driver in this video was about to be a victim of a car crash. The other person made an unsafe left turn, in violation of California Vehicle Code Section 21801(a), without yielding to oncoming traffic. Good job!

In an effort to reduce the staggering number of hit-and-runs in Los Angeles, city officials joined forces Tuesday with the Los Angeles Police Department and the Department of Transportation to announce a city-wide alert system.
“The city of Los Angeles unfortunately has become known as the hit and run capital of the US,” said Damian Kevitt, who lost a leg when he was struck by a hit-and-run driver two years ago.

“When I was hit on the freeway on the streets of Griffith Park and dragged nearly a quarter of a mile underneath the car, I didn’t know my life would change so drastically,” Kevitt said. “All I knew was I wanted to live.”
Councilmen Joe Busciano and Mitchell Englander hope to reduce the epidemic of hit-and-runs in LA with the implementation of a mass notification system that would use social media accounts, including Facebook, Twitter and Instagram, and Nixle to alert residents.

“If we have year, make, model, description of damage to vehicle, the driver perhaps,” Englander said. “If we have that information, then it will go out geographically by division.”
Englander said they have reached out not only to Google and Waze, but also to any company with a dispatch system, including Uber, sanitation services, bus drivers, and metro and taxi drivers.
LA, California Leaders to Crack Down on Hit-and-Runs
Nearly 21,000 hit-and-runs resulted in 27 deaths and 144 severe injuries in LA during 2014, according to LAPD records. With nearly 50 percent of crashes classified as hit-and-runs in the city, LA soars over the national average of 11 percent.
There’s also an effort to create an alert system statewide, called a Yellow Alert. It would work like the current Amber Alert system, using electronic billboards and text messages to alert the public to hit-and-run drivers.
It’s modeled after a program in Colorado called the Medina alert, which has been successful — 76 percent of the hit-and-runs that were displayed on the billboards were solved.
“Anything to catch these criminals that are leaving people on the side of the road, that is what we are going to do,” said Stephanie Saporito, a spokeswoman for Englander.
Additionally, Busciano and Englander will also ask the City Attorney to draft an ordinance that would offer a standing reward for the apprehension and conviction of hit-and-run drivers.

A deliveryman for the Midtown restaurant Mangia 57 has won a $900,000 jury verdict, payback for the anti-Semitic harassment heaped upon him by three supervisors at the eatery.

“It’s a very happy ending — I’m in another world,” said Adam Wiercinski, of Washington Heights.

“They would call him a ‘dirty Jew,’ and when he would say, ‘But I took a bath,’ they would laugh and say, ‘No, you still smell like Jew,’ ” said his lawyer, Matthew Blit.

Night-shift manager Artur Zbozien often “passed gas” in front of Wiercinski, and would then joke that the gas was Zyklon B, the poison used in Nazi gas chambers during the Holocaust, according to the Brooklyn federal court lawsuit.

“How can I explain to you — he passed wind, loudly,” Wiercinski told The Post of Zbozien.

“Everybody laughed, and then he said, ‘See, this is your Zyklon B, you stupid Jew.’

“My father had six siblings — only two of them survived in what is now the Ukraine,” Blit said.

“I had to explain to the members of the jury, what is Zyklon B,” he added. “Because they were very young; they do not know. When I explain how it was used in the gas chambers, they were very serious. Everybody [in the courtroom] was silent.”

Other supervisors would dock Wiercinski’s tips, call him a “Jewish pederast,” and throw pennies at him, again making anti-Semitic jokes, the lawsuit said.

Wiercinski worked at the West 57th Street restaurant from 1992 until 2008, staying despite the abuse because, “He was 50 years old,” explained Blit. “He said, ‘Who else is going to hire a 50-year-old deliveryman.’ He was afraid.”

Jurors heard just three days of testimony last week, including supporting accounts from three of Wiercinski’s outraged co-workers. Much of the testimony was in Polish, the language used by many of the restaurant’s employees. The jury reached a verdict Thursday in just four hours, Blit said.

“He’s in shock,” the lawyer said of Wiercinski’s reaction to the hefty jury award. “He was so happy. It’s a moral victory for him.”

Employees at the restaurant and caterer, which has three Manhattan locations, have denied the harassment took place. The restaurant is expected ask that the verdict be tossed out or that the award be reduced. Calls to its attorney were not immediately returned.

The verdict will be appealed, a lawyer for Mangia 57 said Tuesday, insisting that there was no evidence — besides Wiercinski’s own word — that upper management was ever made aware of any problems.

“Mangia 57 denies and Artur Zbozien denied at trial that anything like this [anti-Semiticism] occurred,” said the lawyer, Daniel Kaiser. “I’m going to ask that this be thrown out entirely, or at least that the award be reduced to a nominal amount.”

Jurors bought Wiercinski’s story despite evidence presented by the defense that between 2000 and 2008, Wiercinski was receiving Social Security disability checks while collecting his full delivery job paycheck under a fictitious name, Adam Jamroz. Wiercinski admitted as much during a pre-trial proceeding, but took the fifth at trial, both sides conceded Tuesday.

Mangia knew who Adam Jamroz was for the past 20 years — if they agreed to let him call himself Adam Jamroz and be paid under that name, the jury saw that they were just as guilty as he was,” countered Blit.

Brooklyn federal Judge Leo Glasser has ordered that the transcript in which Wiercinski described the alleged Social Security fraud be turned over to the US Attorney’s Office, Kaiser said.

As for management purportedly not knowing about the anti-Semitic attacks, “We put in evidence a statement from Artur Zbozien, a sworn affidavit, in which he said that upper management knew about the abuse and transferred him to a different location because of it,” said Blit. “Then, when Zbozien asked to go back, they let him go back” to Mangia 57, Blit added. “That’s what the jury found so outrageous.”

“I’m not sure the defense attorney was at the same trial we were,” Blit added. “The jury got it right.”
